Limitation of Liability.

VacationsForVeterans, LLC and its affiliates, officers, Board Members, volunteers, employess or any agents WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE AND/OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR participation and use of our program offered on this WEBSITE, YOUR UPLOADING OF ANY CONTENT TO THIS WEBSITE, OR ANY DONATION THAT YOU MAKE VIA THIS WEBSITE.

 

Indemnity.

All home donors and timeshare week donors who participate in VacationsForVeterans, LLC, agree to defend, indemnify and hold VacationsForVeterans, LLC, Vacationsforveteran.org, and its affiliates, independent contractors, employees, volunteers, board members, officers, service providers, suppliers, licensors and consultants (the “Indemnified Parties”), harmless from and against any claims, damages, costs, actions, demands, liabilities, and settlements and expenses (including without limitation, reasonable attorneys’ fees) arising out of any participation in this program. You agree to binding arbitration as set forth below for all disputes or claims.

 

All veterans who participate in Vacations for Veterans, LLC, agree to defend, indemnify and hold VacationsForVeterans, LLC, Vacationsforveteran.org, and its home donors, timeshare week donors, monetary donors, affiliates, independent contractors, employees, volunteers, board members, officers, service providers, suppliers, licensors and consultants (the “Indemnified Parties”), harmless from and against any claims, damages, costs, actions, demands, liabilities, and settlements and expenses (including without limitation, reasonable attorneys’ fees) arising out of any participation in this program. You agree to binding arbitration as set forth below for all disputes or claims.

 

Dispute Resolution:

By agreeing to the terms of this site, you agree that these Terms of Use provide that all disputes between you and VacationsForVeterans. LLC, will be resolved by BINDING ARBITRATION. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract. Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury and your claims cannot be brought as a class action.

You and VacationsForVeterans, LLC, agree that any dispute, claim or controversy arising out of or relating in any way to this program or website, including our website, affiliates, partners, customer service, user interfaces, these Terms of Use and this Arbitration Agreement, shall be determined by binding arbitration instead of in courts of general jurisdiction. Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. You agree that, by agreeing to these Terms of Use, the U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision, and that you and VacationsForVeterans.org, Vacations For Veterans, LLC, are each waiving the right to a trial by jury or to participate in a class action. This arbitration provision shall survive termination of this Agreement.

The arbitration will be governed by the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (collectively, "AAA Rules") of the American Arbitration Association ("AAA"), as modified by this Agreement, and will be administered by the AAA. Any arbitration hearings will take place in Fairfax County, Virginia, United States of America, and that except as expressly set forth herein, the payment of all filing, administration and arbitrator fees will be governed by the AAA Rules.
